1. ELIGIBILITY

This Policy applies to the owner of an eligible passenger car or light truck tire that was purchased at retail from Central Tire Corporation, operated in normal highway use, and for non-commercial purposes.

Eligible tires must be used only on the vehicle on which they were originally installed and according to the vehicle manufacturers' recommendations for fitment, air pressure, and operating conditions. Tires used in commercial service, including but not limited to taxicabs, police pursuit cars, emergency vehicles, vocational trades vehicles, and non-passenger service vehicles, are not eligible for the Tread Wear-Out Coverage of this Policy.

A tire is eligible for replacement under the terms of the Policy when it is evenly worn to the legal minimum tread depth of 2/32 inch and has not reached the specified mileage covered or the months of service covered. Tires purchased or installed as used tires are not eligible under the Policy.

2. TIRE OWNER OBLIGATIONS

You are responsible for proper maintenance of your tires and your vehicle. This includes having the tires rotated at the prescribed intervals, maintaining air pressure at the levels specified by the vehicle manufacturer, and keeping the applicable vehicle component parts and adjustments within specified tolerances.

Premature tire wear-out caused by improper maintenance of the tires or the vehicle voids the tread wear coverage portions of the warranty. See Section 6 for specific exclusions and general conditions that are not covered by the Tire Wear-Out Warranty.

Any charges for tires that must be demounted due to uneven wear, directional or asymmetric tread patterns, or the unique design of wheels will be paid by the owner. The owner shall also pay the costs of rebalancing of tires when needed.

The owner shall bring the vehicle to Central Tire for periodic tire inspections and rotation at a mileage interval that does not exceed 5000 miles. Central Tire may recommend a tire rotation interval that is different from the normal 5000-mile interval.

The owner must maintain certain records and documentation. This includes the original or a copy of the purchase invoice and this warranty form, which includes the tire rotation record.

3. CENTRAL TIRE OBLIGATIONS

At no charge to the consumer, Central Tire will perform general tire inspections, free tire rotation, and set tires to the proper inflation levels for any passenger or light truck tire covered by this warranty. Central Tire will check and set air pressure at any time the owner desires. There is no charge for this service.

4. TREAD WEAR.OUT POLICY AND TERM LIMITATIONS

Subject to the conditions, exclusions, and limitations listed in Section 6, if the tread on a tire, which had mileage coverage offered at the time of the sale, wears down with an even wear pattern to the legal minimum as shown by the tread wear indicators (2/32" of tread depth) and before the listed mileage or months of service, whichever comes first, the owner will receive a comparable new tire at a replacement charge based on the percentage of actual mileage received as described in Section 5. A comparable tire may be of either the same tire line, if still available, or a tire of the same basic construction but with a different sidewall or tread configuration. If a higher-priced tire is accepted as replacement, the owner will pay the difference in price.

The actual mileage received may be different from the mileage coverage listed because of variations in driving habits, driving conditions, and vehicle characteristics. Nevertheless, the tire(s) will be replaced subject to the terms and conditions described in the Tread Wear-Out Coverage if the listed mileage was not received. If a tire does not have Mileage Coverage, then the Policy does not apply.

An original or copy of the original sales invoice plus the Tire Rotation Schedule, which is printed in this brochure, are required in order to receive a tire replacement or a credit under the terms of this Policy.

5. HOW PRO-RATA CREDITS ARE CALCULATED

You will receive a replacement tire with the payment of a replacement charge based upon the percentage of actual mileage received to the mileage covered.

The adjustment base price will be the retail price in effect at the time that the replacement is made.

Charges for related labor, environmental charges, and taxes that apply to the replacement are not included in the warranty coverage and will be paid by the owner.

Central Tire Corporation reserves the right to issue a refund in lieu of a replacement and in such case the adjustment base price will be the price paid by the owner for the original tire. The owner will be charged for the unused tread depth if the tread depth exceeds the 2/32-inch legal minimum.

6. WHAT IS NOT COVERED UNDER THE TREAD WEAR-OUT LIMITED WARRANTY?

A. The following specific conditions are not covered: Premature tread wear or abuse that results from mechanical conditions such as, but not limited to, wheel alignment, steering or suspension components, shocks/struts, bearings, brake components, collision damage, chemical deterioration, chain damage, extreme temperatures, tire spinning, improper or damaged rims, failure to rotate tires, or other user negligence.

Tires damaged or premature tread wear from improper inflation, overloading, improper application, or use in excess of the capabilities of the tire as specified by the tire manufacturer. Road Hazards, cuts, snags, punctures, bruises, impact breaks, run--flat, and any other user-inflicted damage. The owner may have other coverage for tire repairs and road hazard damage.

Tires rendered unsafe or inoperable because of improper tire repairs not performed at Central Tire.

Premature wear from unusually aggressive or abusive driving.

B. General Exclusions

Tire(s) submitted for wear-out as covered in Section 1 that were in service for more than the mileage coverage or months of service coverage, whichever comes first.

Tires(s) submitted for wear-out that have not been rotated at least every 5000 miles or as otherwise specified by Central Tire. This will be determined by the Tire Rotation Record portion of this Warranty Certificate or the Central Tire computerized service history. Tires transferred to another vehicle or tires owned by someone other than the original purchaser.

Tires used in any competitive event such as racing, autocross, road rally, etc.

DOES NOT EXTEND WARRANTIES, EITHER EXPRESS OR IMPLIED, FOR COVERAGE OTHER THAN TREAD WEAR. CENTRAL TIRE CORP. DOES NOT ASSUME ANY WARRANTY OR LEGAL OBLIGATION OF ANY MANUFACTURER, DISTRIBUTOR, OR IMPORTER OF ANY PRODUCT OFFERED FOR SALE BY CENTRAL TIRE CORP.

NO CENTRAL TIRE CORP. EMPLOYEE OR DEALER HAS THE AUTHORITY TO MAKE ANY WARRANTY, REPRESENTATION, PROMISE, OR AGREEMENT ON BEHALF OF CENTRAL TIRE CORP. EXCEPT AS STATED IN THIS LIMITED WARRANTY.

TO THE EXTENT PERMITTED BY LAW, CENTRAL TIRE CORP. DISCLAIMS LIABILITY FOR ALL CONSEQUENTIAL AND INCIDENTAL DAMAGES. THE REMEDIES SET FORTH IN THIS LIMITED WARRANTY ARE THE SOLE AND EXCLUSIVE REMEDIES FOR BREACH OF WARRANTY SUBJECT TO LEGAL REMEDIES IMPOSED BY THE APPLICABLE JURISDICTION. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS THAT MAY VARY FROM STATE TO STATE.
